Agreement to Terms and Conditions of Use for Triage App
PLEASE READ THESE TERMS OF USE SET OUT BELOW ("TERMS OF USE") CAREFULLY. THESE TERMS OF USE CREATE A LEGAL BINDING AGREEMENT BETWEEN YOU (AS DEFINED BELOW) AND TRIAGE TECHNOLOGIES, INC. AND ITS AFFILIATES (COLLECTIVELY, "TRIAGE" "WE" OR "US").
THESE TERMS OF USE GOVERN YOUR ACCESS TO AND USE OF THE TRIAGE WEBSITE LOCATED AT WWW.TRIAGE.COM (THE "SITE"), THE TRIAGE MOBILE AND WEB APP (THE "TRIAGE APP"), THE SERVICES PROVIDED BY TRIAGE IN CONNECTION WITH THE SITE OR THE TRIAGE APP (THE "SERVICES"), AND THE MESSAGES, INFORMATION, DATA, TEXT, VIDEOS, IMAGES AND OTHER CONTENT AVAILABLE ON OR THROUGH THE SITE, THE TRIAGE APP OR THE SERVICES (COLLECTIVELY THE "CONTENT", AND TOGETHER WITH THE SITE, THE TRIAGE APP AND THE SERVICES, THE "PLATFORM").
THE PLATFORM IS PROVIDED BY TRIAGE SOLELY FOR THE LIMITED PURPOSES IDENTIFIED IN THESE TERMS OF USE AND ITS USE BY YOU IS CONDITIONAL ON YOUR ACCEPTANCE OF THESE TERMS OF USE. IN ORDER TO ENTER INTO THIS AGREEMENT AND TO USE THE PLATFORM YOU MUST BE THE OLDER OF: (A) 18 YEARS OLD; OR (B) THE LEGAL AGE OF MAJORITY IN YOUR JURISDICTION OF RESIDENCE.
Triage may, in its sole discretion, change, add, remove, or update part or all of these Terms of Use at any time simply by revising them on the Site. It is your responsibility to check the date of the "Last Update" to these Terms of Use periodically to determine whether any changes have been made. If any change in these Terms of Use is not acceptable to you, discontinue your use of the Platform. Your continuing use following such changes will constitute acceptance of them.
1. Important Limitations of the Platform
The Triage App is licensed in Canada. The Triage App has not been approved by the U.S. Food and Drug Administration for use by U.S. consumers. As of the last modification date of these Terms of Use, the Triage App is intended for Investigative Use Only in the U.S. in connection with a non-clinical evaluation by healthcare professionals and investigators (collectively, "HCPs" as more fully defined in Sec. 3 below) or with a clinical trial or study by an HCP involving the Triage App.
If you are a U.S. consumer or other non-HCP, you should not use the Triage App or Services at this time.
The Triage App and the Services do not diagnose whether an individual has a certain skin condition. They are investigative tools that assists you (the "User" as more fully defined in Sec. 3 below) in identifying certain potential types of skin conditions by comparing the pictures and information you provide ("User Content" as more fully defined in Sec. 4 below) to the data in the Triage clinical database. The accuracy of the Services will vary depending on, among other things, the quality of photos you submit, the accuracy of the information you provide, and the data contained in the Triage clinical database.
2. Changes to the Platform
Triage may, at any time without notice or liability, and for any reason whatsoever, terminate, change, suspend, or discontinue any aspect of the Platform including, without limitation: (i) changing the availability of, restricting access to, or imposing limits on any or all features or Services on, or links to, the Platform; (ii) adding, removing, or changing any fees or charges for use of the Platform or any features of the Platform; or (iii) removing, adding, modifying, or otherwise changing any Content or Services of the Platform. Triage reserves the right, in its sole discretion, to correct any errors or omissions in any portion of the Platform at any time without notice, but disclaims any duty to do so.
3. Accounts
In order to use the Triage App or to receive the Services, you must register for a Triage account (an "Account" and each Account holder, a "User"). If you visit, access or otherwise use this Platform as an individual on your own behalf under an Account registered to you as an individual, you must ensure that no other individual uses or otherwise accesses your Account.
4. User Content
All information, data, text, software, images, videos, or other content that a User may post, submit, link to, or otherwise make available to, on, or through the Platform ("User Content") is solely the responsibility of such User. All User Content that you provide through this Platform or in connection with any Services should be true, accurate, current, and complete and not be misleading. You should update your Account information promptly upon the occurrence of any change in such information.

Triage Technologies, Inc. and its affiliates (collectively, "Triage", "we", or "us") recognize the importance of privacy. The purpose of this privacy statement ("Privacy Statement") is to inform you about our privacy practices, including how we collect, use and disclose your Personal Information.
Meaning of Personal Information
"Personal Information" means information about an identifiable individual. This information may include, but is not limited to, your name, e-mail address, and telephone number.
According to applicable Canadian laws, Personal Information does not include any business contact information that is solely used to communicate with you in relation to your employment, business or profession, such as your name, position name or title, work address, work telephone number, work fax number or work electronic address.
Personal Information also does not include information that has been anonymized or aggregated in such a way that there is no serious possibility it can be used to identify an individual, whether on its own or in combination with other information.
